Welcome to NJWEBDESIGNING. By accessing and using our website njwebdesigning.in, you agree to comply with and be bound by the following terms. If you do not agree, please refrain from using our services.
1. About Us
NJWEBDESIGNING is a freelance web design and development business operated as a sole proprietorship, registered under the MSME (Udyam) scheme. Our business is based in Idappadi, Salem, Tamil Nadu, India.
2. Scope Of Services
NJWEBDESIGNING provides freelance web design and development services including website design, development, setup, and related consultation. All services are based on terms outlined in individual client agreements.
3. Client Responsibilities
- Clients are responsible for providing all necessary content, materials, and information required for project completion.
- Timely feedback and approvals are essential to maintain agreed project timelines.
- Delays caused by the client’s failure to provide inputs may result in revised timelines or additional charges.
4. Project Terms
- Each project will be outlined in a separate written agreement specifying scope, deliverables, and timeline.
- Any changes to the agreed project scope (scope creep) may result in additional fees and revised timelines.
- NJWEBDESIGNING reserves the right to decline projects at its discretion.
5. Hosting & Third-Party Services
- NJWEBDESIGNING does not directly provide web hosting, domain registration, or third-party server infrastructure unless explicitly mentioned in the project agreement.
- Clients are free to choose their preferred hosting provider such as Hostinger, GoDaddy, or others.
- We can assist clients with purchasing hosting and domains, initial setup, SSL configuration, domain connection, and website deployment. This may be included in the project cost or charged separately.
- Hosting fees, domain renewal charges, and third-party service costs are solely the client’s responsibility.
- NJWEBDESIGNING is not responsible for downtime, data loss, pricing changes, or issues caused by third-party hosting or domain providers.
- Clients retain full ownership of their hosting accounts and domains unless otherwise agreed in writing.
6. Payments
- A minimum advance payment of 50% of the total project amount is required before work commences.
- The remaining balance is due upon project completion and before final delivery of files.
- Late payments may result in project delays or suspension of work.
- Payment terms are detailed in individual project contracts.
7. Intellectual Property
- Full ownership and intellectual property rights of the completed project are transferred to the client only upon receipt of full and final payment.
- Until complete payment is received, NJWEBDESIGNING retains all rights to the work produced.
- NJWEBDESIGNING reserves the right to display completed work in its portfolio and marketing materials, unless the client explicitly requests otherwise in writing.
8. Confidentiality
- NJWEBDESIGNING agrees to keep all client-provided information strictly confidential.
- Clients agree not to disclose any proprietary information, processes, or methodologies belonging to NJWEBDESIGNING.
9. Refund & Cancellation
- Refund policies will be outlined in individual project contracts.
- Refunds are subject to the terms agreed upon in the contract.
- Deposits are non-refundable.
10. Termination
- Either party may terminate a project by providing written notice.
- In the event of termination, payment will be due for all work completed up to the date of termination.
- Specific termination terms will be outlined in individual project contracts.
11. Limitation of Liability
- NJWEBDESIGNING shall not be liable for any indirect, consequential, or incidental damages arising from the use of our services.
- Our total liability is limited to the amount paid by the client for the specific service in question.
12. Governing Law & Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Salem, Tamil Nadu, India.
13. Amendments
NJWEBDESIGNING reserves the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our services constitutes acceptance of the revised terms.
